Cancellation Policy (Distance Selling Act)

 

Cancellation Policy for private end consumers in Austria (pursuant to Distance Selling Act BGBl. I Nr. 185/1999) valid for goods ordered online and shipped to you!

Customers, considered consumers pursuant to the provisions of the Consumer Protection Act, are granted the right to withdraw from the distance contract (or from a distance pre-contract) for a period of 14 calendar days from delivery of the good ordered. It shall be considered sufficient if the letter of resignation is sent within this period without statement of reasons. Saturdays, Sundays and holidays shall be included in the calculation of the period. In any case, there are 7 working days available (without Saturdays, Sundays and holidays). In case of withdrawal a partial or complete refund of the purchase price will be performed only step by step against the deferment of the goods received by the customer. The costs for deferment shall be borne by the customer.

The goods must be unused, in a resalable condition and must be returned in their original packing. For articles impaired by signs of usage or with damaged packing we will charge an appropriate fee for depreciation. The same shall be valid for parts or accessories missing at the point of return.

Cancellations must be made directly and in writing to BiologoN GmbH, Mühltal 4, 6305 Itter, Austria.

Please note:
a) We would also like to inform you that in case of return without the original packing you, if necessary, may be liable to pay compensation. We therefore advise you to keep the original packing until you have decided not to make any use of your right of revocation.


b) A right of revocation shall not be possible should:

§  the goods have been manufactured according to customer specifications or have specifically been tailored to your personal needs or if the goods are not apt for return due to their nature.

§  In case of collection at our location where personal viewing is possible

§  Contracts completed in form of auctions

§  Goods or services whose price is dependent on the development of the     financial markets BiologoN GmbH is not having any influence on.

Revocation policy for private end customers from the European Area

The following legal provisions for right of revocation shall be considered agreed (contrary to the Austrian right of revocation) for each customer from the respective state:

Revocations must be sent directly to BiologoN GmbH, Mühltal 4, 6305 Itter, Austria in writing.

Belgium: The right of revocation comprises 7 working days and commences on the day following the delivery of the goods. The user shall bear the direct costs of the return provided that the goods delivered do not comply with the product description.

Germany: (pursuant to Distance Selling Act BGBl Vol. 2008 Part 1 No. 8 issued at Bonn on March 12, 2008). Valid for goods ordered online and shipped to you! You have the right to withdraw from a distant selling contract within 2 weeks from the closing of the contract in writing without giving reasons (e.g. by letter, fax or e-mail) or by returning the goods. The deadline shall commence upon receipt of this written instructions. In order to assure that the withdrawal is performed within the respite it is sufficient to send it or to return the good in time.

In case of effective revocation the mutually received services are to be granted back including possibly drawn benefit (e.g. interest). Should you not be able to return the goods or only return them partially or in a deteriorated condition then you will be obligated to value replacement. In the case of goods surrendered this does not apply if the deterioration of the goods is brought about solely by a tryout thereof - such as would have been possible for you e.g. in a retail shop. Moreover, you may avoid any duty to provide compensation for any deterioration of the goods caused by the intended use, by not using the goods as your own property and refraining from all actions that may affect its value. Goods capable of being sent by parcel post should be returned to us at our risk and costs. Non transportable things will be picked up at your location. Obligations to refund payments must be met within 30 days. The deadline shall commence with dispatch of your declaration of revocation or of the good, for us upon receipt.

Denmark: The right of revocation comprises 14 days and commences on the day of the delivery of the goods. The user shall bear the direct costs of the return.

Finland: The right of revocation comprises 14 days and basically commences on the day following the receipt of a written confirmation by the user, but in case of delivery of goods upon receipt, provided a written order confirmation has been sent to the user in advance. In case the time limit expires on a Saturday or on a holiday, the period shall be prolonged until the next working day. The entrepreneur shall refund the consumer the costs of the return of the goods, provided the returned goods can be transported by postal service.

France: The right of revocation comprises 7 days and commences on the day of receipt of the goods by the user. In case the time limit expires on a Saturday, a Sunday or on a public holiday, the period shall be prolonged until the next working day. The user shall bear the direct costs of the return of the goods.

Greece: The right of revocation comprises 10 days and commences on the day of receipt of the goods by the user. The user shall bear the direct costs of the return of the goods and must also return the goods in their original state.

Great Britain: The right of revocation comprises 7 working days and commences on the day following the receipt of the goods by the user. The user shall bear the direct costs of the return of the goods, provided it has explicitly been agreed by contract that the customer must return the goods in case of revocation. If no such agreement has been reached, the online shop shall collect the goods at its costs.

Ireland: The right of revocation comprises 7 days and commences on the day of receipt of the goods by the user. The user shall bear the direct costs of the return of the goods.

Italy: The right of revocation comprises 10 working days and commences on the day of receipt of the goods by the user. Effective exercise of the right of revocation shall only be possible if the user communicates the revocation to the entrepreneur by means of registered mail including a receipt. The user shall bear the costs of the return of the goods.

Luxembourg: The right of revocation comprises 7 working days and commences on the day of receipt of the goods by the user. The user shall bear the direct costs of the return of the goods.

Netherlands: The right of revocation comprises 7 working days and commences on the day of receipt of the goods by the user. The user shall bear the direct costs of the return of the goods.

Portugal: The right of revocation comprises 14 days and commences on the day of receipt of the goods by the user. The user is explicitly advised to ensure the goods received to be in good condition. The user must communicate the revocation by means of registered mail including a receipt and he shall bear the direct costs of the return of the goods.

Sweden: The right of revocation comprises 14 days and commences on the day of receipt of the goods by the user. The user shall bear the direct costs of the return of the goods.

Switzerland: There is no legal right of revocation for distance selling acts in Switzerland.  

Spain: The right of revocation comprises 7 working days and commences on the day of receipt of the goods. In case the services received are not refunded to the user within the 30 day-deadline the user shall have the right to assert two-times the original amount paid. The user shall bear the direct costs of the return of the goods.
